1. The service
AccessProof provides automated website accessibility scanning against the WCAG 2.1/2.2 A/AA and EN 301 549 rule sets, scheduled monitoring, reports, and generators for accessibility statements and accessibility conformance reports (VPAT-style documents). The service is operated by Benchfour, a sole proprietorship based in India.
2. What the service is not
AccessProof does not certify, guarantee, or provide legal assurance of compliance with any law or standard. Automated testing detects roughly 30% of WCAG success criteria. Reports are evidence of testing effort, not proof of conformance. Generated statements and conformance reports are self-declarations that you are responsible for reviewing and standing behind. Nothing in the service is legal advice; consult a qualified professional for legal questions.
3. Acceptable use
- Only scan websites you own, operate, or are authorised to assess (for example, a client engagement).
- Don't attempt to overload the service, evade rate limits, or access other users' data.
- Don't misrepresent white-labeled reports — the underlying findings must not be altered before being passed to a client.
We may suspend accounts that violate these rules.
4. Accounts and plans
You're responsible for the email account used for sign-in links. Paid subscriptions are sold and billed by Lemon Squeezy as merchant of record; their checkout terms and refund policy apply to payment matters. Plan limits (number of monitored sites, features) are as described on the pricing page and may evolve; we'll give reasonable notice of changes that reduce what you receive.
5. Your content and ours
The websites you scan and the documents you generate are yours. The service, its code, scoring methodology, and site content are ours. You may use generated reports, statements, and conformance documents freely, including commercially.
6. Liability
The service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect or consequential damages — including legal claims, fines, or enforcement actions relating to your website's accessibility — and our total liability for any claim is limited to the amounts you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited, or your statutory rights as a consumer.
7. Termination
You can stop using the service and delete your account at any time (email [email protected]). We may terminate accounts for breach of these terms. On termination your stored data is deleted per the privacy policy.
8. General
These terms are governed by the laws of India, without affecting any mandatory consumer protections that apply in your country of residence. If any clause is found unenforceable, the rest still applies. We may update these terms; material changes will be announced to account holders by email, and continued use after the effective date is acceptance.
